Student Body Scholarship Association (SBSA) Membership and Tuition Funding Program Agreements.
This Agreement constitutes a legally binding contract between the Student Body Scholarship Association (SBSA) and TuitionFunding.org. Each individual person/student who enrolls into or participates in SBSA’s Tuitionfunding.org online or offline tuition fundraising platforms.
By enrolling into the SBSA’s student tuition funding program, you acknowledge that you have read and understood this Agreement and that you agree to be bound by all its terms.
Participants must be in the process or currently enrolled in an intuition of higher learning or Trade/ Vocational school. Former students who currently owe student-loan debt of any amount also qualify to use our online platform.
Participants must be at least 18 years of age the day of enrolling in our program.
Those who enroll in our program through our website registration represent that you are a person of legal age in the state in which you live (generally at least 18 depending on the state) and are a U.S. citizen, legal resident, or reside in the United States or its territories, or a legal international resident of where you reside.
You agree that it is your responsibility to keep your contact information current, complete and accurate by periodically updating your information in the appropriate section of our
website or by contacting us via email to update your new information.
Subject to this Agreement, we hereby grant you a nonexclusive, nontransferable license (without the right to sublicense) for so long as you participate in the Service and
adhere to this Agreement, to access, participate in and use the Service. You agree that you obtain no rights other than the rights and licenses expressly granted in this Agreement.
Legal Guardianship
Underaged children, anyone under 18 years of age must have a legal guardian enroll on the child’s behalf. The adult guardian will receive any sponsored tuition collected on behalf of the minor child.
Tuition Funding Guidelines:
High school, college, community colleges, online colleges, Universities, Former students with student-loan debt, trade school and vocational school students who are planning
or currently enrolled into the aforementioned institutions, that need financial help with their tuition qualifies to participate in SBSA’s Tuition Funding program. All campaigns will have ten percent of the collected funds deducted from the overall money collected from each campaign after the deductions of any credit or debit card processing fee.
SBSA / Tuition Funding makes no implied guarantees that students will reach their preset tuition goals or receive any tuition in their campaign whatsoever. SBSA/Tuition Funding will, however, advance any monies collected in each student’s campaign account to said student minus the above-mentioned deductions. Through membership or enrollment fees in part SBSA will also advertise and promote its Tuition Funding program through different forms of media.
Students participating in the SBSA’s Tuition Funding online platform unless using our paid service must create their own tuition funding campaign page which will be granted after payment to use said services has been completed.
SBSA/ Tuition Funding reserves the right to issue collected tuition directly to the student or the learning institution in which the student is currently attending.
Any campaign under $100 may be paid to the student at the end of each calendar year or at SBSA’s discretion.
Any fraudulent student campaigns, “anyone creating a campaign that is not a student or does not plan to become one in the near future” will lose the right to collect any tuition already collected in their campaign. This does not apply to minor children who may not be able to attend high school, college, or paid learning intuition until a mature age. Abandoned campaigns or campaigns where the enrolled student cannot be found after an extended period of time of reaching their preset tuition goal or 6 months after the end of the year when all payments are sent out will forfeit all collected campaign funds which will be transferred to SBSA and used for its administrative costs, scholarship programs or any other operating expense that SBSA sees fit.
SBSA currently offers three levels of participation/membership services for enrollment or use of the Tuition Funding program. A one-time enrollment/registration fee of $20, $50, or $500 depending on the registration level seeking is required of each induvial in order to use our platform to raise funding for their education.
SBSA Lifetime Membership Enrollment:
The Student Body Scholarship Association is primarily a scholarship/tuition-based nonprofit organization created to receive public, private, and or corporate tax-deductible donations in an effort to assist students who feel they need help with their tuition-based institution. As such SBSA is currently allowing a certain number of students, to be determined at a later date, to enroll in SBSA’s Lifetime Membership Program. This $500 dollar student membership program is open to current or future students at SBSA’s sole discretion. SBSA has the right to refuse membership of any enrolled student at any level. Refused Lifetime Membership Enrollments will be issued a refund of the full amount of the enrollment fee once the enrollee pays the $500 enrollment fee. Student Body Scholarship Association lifetime members will receive special benefits including substantial discounts on apparel, SBSA’s live events, and other venues paid or complementary events. They will also be able to participate in our future profit-sharing program which is to be determined and finalized at a later date in the future. Once finalized SBSA lifetime membership students can receive up to a total of $100,000 dollars for their initial $500 membership investment into the corporation. Each lifetime student member can receive no greater than a total of $100,000 per their lifetime membership. All lifetime student members must remain in good standings with SBSA in an effort to receive shared profits that are collected by SBSA.
The Student Body Scholarship Association (SBSA) make no implied guarantee that any student enrollees into SBSAs lifetime membership program will receive any profit-sharing payments or donations of any kind to their tuition campaign and that any participation in SBSA’s fundraising platform and lifetime membership program is a monetary at-risk business endeavor.
Student-Athletes:
Student-athletes who need help with tuition can participate in our Tuition Funding program. However, each student must check with their learning institution college, or university in Student-Athletes Division's I, II, or III or any other collegiate college to ensure legal participation is our program.
In addition, any student-athlete must enquire within their school or check with the NCAA’s legislative legal department to ensure such participation in our Tuition Funding program
falls within the guidelines of NCAA student-athlete eligibility rules.
Grants and Tuition Sponsorship Funding:
SBSA is not a guaranteed funding source. Unless stipulated per each induvial campaign SBSA does offer a Fiscal and yearly sponsorship for its student enrollees.
SBSA does sometimes co-sponsor or contributes to tuition campaigns upon its discretion when such sponsorship opportunities arise but is not obligated to do so.
Applied Fees:
SBSA / Tuition Funding deducts 10% from all donations, while the payment processor
charges 3% per donation transaction. A total of 13% will be deducted from accumulated donations of each campaign.
Policies:
You agree to comply with this Agreement, and all other policies, rules, and terms and conditions as set forth in Service materials, including materials of Contributing Companies, either in print or on our website (collectively, the "Policies"). The Policies, including any amendments which may be made from time to time, are hereby incorporated by reference into this Agreement.
We may modify this Agreement or the Policies at any time in accordance with this Agreement. You acknowledge and agree that any information you provide to a ContributingCompany is subject to that Contributing Company's own privacy and data collection policies.
Tuition Funding Agreement or Agreements for SBSA, and guarantor shall protect, indemnify and hold the Student Body Scholarship Association, the Tuition Sponsorship Program, its assignees, and owner of any chapter / chartered property harmless from and against any and all obligations, liabilities, costs, damages, claims, and expenses of whatever nature and kind arising out of or in connection with the Tuition Sponsorship Program.
SBSA/Tuition Funding Obligations:
No Unauthorized Use of the Service. You agree that you will not, and will not permit others to:
A. Provide any unauthorized third party with access to the Service or any information, data, text, links, images, software, chat, communications, and other content available through the Internet and proprietary to SBSA (collectively, "Content") by any means;
B. Engage in any activity that does not comply with U.S. law or other applicable law and regulations or otherwise engage in any illegal, manipulative or misleading activity through the use of our services;
C. Introduce into the Service any code intended to disrupt the Service, alter or delete its Content, access confidential Content on our website, or interfere with the operation of the Service, including, but not limited to, distribution of unsolicited advertising or mail messages and propagation of computer worms and viruses;
D. Post any material in any form whatsoever on our website or within the Service that is defamatory, obscene, or otherwise unlawful or violates any third party's right of privacy or publicity; or infringe any third party's patent, copyright, service mark, trademark or other intellectual property right of any kind or misappropriate the trade secrets of any third party in connection with your use of the Service.
Termination:
Expiration or Forfeiture of the Tuition Funding; Rights to Contributions. This Agreement is effective when accepted by you, as described in the first paragraph of this Agreement, and will remain in effect and legally bind you and us until you or we terminate the Service.
Upon any violation or perceived violation of this contract, SBSA can terminate your participation in the tuition sponsorship program in the service with cause at any time
immediately after notice to you of such termination. Upon any termination due to a violation of this contract of your personal tuition sponsorship program, SBSA reserves the
right to close and delete enrolled student-sponsored accounts with any collected tuition automatically put in SBSA overall accounts to be used as SBSA sees fit.
Anyone who fraudulently set up an account to raise money on their behalf will forfeit all proceeds generated in the program which will go to SBSA.
Misrepresentation:
Any member who willfully and fraudulently misrepresents SBSA/Tuition Funding in any form shall be terminated immediately.
Amendments:
SBSA/Tuition Funding may amend this Agreement from time to time by posting an updated Agreement on the sb-sa.org or tuitionfunding.org website or by email. If SBSA materially changes this Agreement, we will notify you by email at the email address specified in your account and/or through a notice on our website at least 30 days prior to the effective date of the amendment.
Your continued participation in the SBSA's Tuition Funding program after an updated Agreement is posted on our website, or 30 days after the notice is provided to you by email or by a notice posted on our website, as applicable, will constitute your affirmative acceptance by you of such amendment and your consent to abide by any terms thereof.
Limitation of Liability:
None of SBSA , SBSA investments, any contributing company, pass-through retailer linked account manager or custody bank, or any of their respective officers, directors, employees, agents, successors, or affiliates are responsible or liable for any
special, incidental consequential, punitive, or other indirect damages or for loss of profits,
loss of data or loss of use damages, that result from the use of, or the inability to use membership services, the information contained on the SBSA website, or (except in the case of the applicable contributing companies or supplier) any merchandise, products or services offered by contributing companies or suppliers in conjunction with the service, even if any such entity has been advised of the possibility of such damages because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages in such states or jurisdictions our liability will be limited to the extent permitted by law.
In no event will SBSA and SBSA investments total liability to you from all damages, losses, and causes of action resulting from your use of the SBSA website or participation in the service, whether in contract, tort. (Including, but not limited to negligence) strict liability or otherwise, exceed the largest amount of contributions in the amount while this agreement is in effect.
Entire Agreement:
This Agreement represents the entire agreement between the parties hereto with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements or
representations, written or oral, concerning the subject matter hereof (including without limitation, earlier versions of this Agreement that may have been accepted by you through
the SBSA website or otherwise). We reserve the right to modify this Agreement at any time.
You acknowledge that the most recent version of this Agreement will be located on the SBSA website under Tuition Funding / Fundraising Agreement. By submitting this
application you agree to all the above terms.
